Embody Fit Terms of Service

Welcome to Embody Fit, a web-based fitness platform operated by Embody Fit LLC (“Embody Fit,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the Embody Fit website, programs, and services (collectively, the “Service”).

By creating an account, accessing the website, or using the Service, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Eligibility

You must be at least 18 years old to create an account and use the Service.

If you are under 18, you may only use the Service with the supervision and consent of a parent or legal guardian.

2. Health and Medical Disclaimer

The Service provides fitness, exercise, and general wellness information intended for educational purposes only.

Embody Fit does not provide medical advice.

Before beginning any exercise program, you should consult with a licensed healthcare professional, particularly if you:

  • have a medical condition
  • have a history of injury
  • are pregnant
  • experience pain or discomfort during exercise

By using the Service, you acknowledge that:

  • exercise carries inherent risks
  • you voluntarily participate in all workouts and activities
  • you assume full responsibility for any injuries, health issues, or damages that may result

To the fullest extent permitted by law, Embody Fit LLC is not liable for any injuries or damages resulting from participation in exercises or use of the Service.

3. Accounts

To access certain features of the Service, you must create an account.

You agree to:

  • provide accurate and complete information
  • maintain the security of your login credentials
  • notify us immediately of unauthorized account use

You are responsible for all activity that occurs under your account.

Accounts are non-transferable and may not be shared.

4. Acceptable Use

You agree not to:

  • use the Service for any unlawful purpose
  • copy, distribute, or resell workout programs or materials
  • attempt to reverse engineer or interfere with the website
  • upload harmful, abusive, or inappropriate content
  • impersonate another user

We reserve the right to suspend or terminate accounts that violate these rules.

5. Subscriptions and Billing

Some features of the Service require a paid subscription.

By subscribing, you agree that:

  • your payment method will be charged the subscription fee displayed at checkout
  • subscriptions automatically renew at the end of each billing cycle unless canceled before renewal
  • billing is processed through our third-party payment processor, Stripe

Prices may change in the future. If pricing changes, users will be notified prior to renewal.

6. Cancellation Policy

You may cancel your subscription at any time through your account settings.

Cancellation will take effect at the end of the current billing period.

After cancellation:

  • you will continue to have access until the end of the paid period
  • you will not be charged for the next billing cycle

Deleting your account does not automatically cancel your subscription.

7. Refund Policy

Due to the immediate digital access provided to workout programs and content, all payments are final and non-refundable.

Refunds will only be issued in the following situations:

  • duplicate charges
  • billing errors
  • technical issues that prevent access to the Service

Refund requests must be submitted within 7 days of the charge.

We reserve the right to determine refund eligibility at our sole discretion. Any disputes

8. Intellectual Property

All content on the Service, including but not limited to:

  • workout programs
  • exercise demonstrations
  • videos
  • graphics
  • logos
  • written content

is the property of Embody Fit LLC and is protected by copyright and intellectual property laws.

You may not:

  • reproduce
  • distribute
  • modify
  • publicly share
  • sell
  • create derivative works

from any Embody Fit content without written permission.

Your subscription provides personal, non-commercial access only.

9. User Content

If the Service allows you to submit content (such as comments, display names, or activity sharing), you grant Embody Fit a non-exclusive, worldwide license to display and use that content within the Service.

You are responsible for ensuring that any content you submit does not violate laws or the rights of others.

10. Termination

We may suspend or terminate your account at any time if:

  • you violate these Terms
  • your use poses risk to the Service or other users
  • required by law

Upon termination, access to the Service may be revoked immediately.

11. Limitation of Liability and Disputes

To the fullest extent permitted by law, Embody Fit LLC and its affiliates will not be liable for:

  • indirect damages
  • incidental damages
  • loss of profits
  • loss of data
  • injuries related to participation in exercise programs

Your use of the Service is at your own risk.

For any dispute between you and Embody Fit LLC arising out of or relating to this Agreement (including any alleged breach thereof), the Service, or the Site, you agree to first contact Embody Fit LLC at admin@embody-fit.com and to attempt to resolve such dispute with us informally. In the event that we are not able to resolve any dispute that you bring to our attention informally, you and we agree that the exclusive means of resolving any dispute or claim arising out of or relating to this Agreement (including any alleged breach thereof), the Service, or the Site shall be binding arbitration conducted by a single arbitrator.

12. Indemnification

You agree to indemnify and hold harmless Embody Fit LLC from any claims, damages, or liabilities arising from:

  • your use of the Service
  • violation of these Terms
  • misuse of the workout programs

13. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict of law principles.

Any disputes must be resolved in the courts located within New Jersey.

14. Changes to These Terms

We may update these Terms periodically.

When updates occur, the Effective Date will be revised.

Continued use of the Service after changes constitutes acceptance of the updated Terms.
